OUR APP AND OUR SITE ARE INTENDED FOR USERS LOCATED IN THE UNITED STATES, MEXICO, AND CANADA, AND ARE NOT INTENDED FOR USERS LOCATED IN ANY OTHER COUNTRIES, INCLUDING THE EUROPEAN UNION AND THE EUROPEAN ECONOMIC AREA.

OUR APP AND OUR SITE ARE NOT INTENDED FOR USE BY MINORS. WE DO NOT KNOWINGLY COLLECT PERSONAL INFORMATION FROM CHILDREN UNDER THE AGE OF 16, AND OUR APP AND SITE ARE NOT DIRECTED TO CHILDREN UNDER 13. MINORS ARE NOT ALLOWED TO MAKE PURCHASES OR APPLY FOR JOBS ON THE APP OR THE SITE AND SHOULD NOT POST ANY PERSONAL INFORMATION TO THE APP OR THE SITE.

INTRODUCTION

Good Manners Freight, LLC (“Good Manners Freight,” “GMF,” “we,” “us,” or “our”) is committed to protecting the privacy and security of the personal information we collect, use, share, and otherwise process as part of our business. We also believe in transparency, and we are committed to informing you about how we treat the data we collect and process in accordance with applicable law. We have established this Privacy Policy (the “Policy”) to inform you about the privacy practices that we apply to personal information and to inform you about your rights and choices in this regard.

This Policy describes our practices regarding your personal information when you use or visit our mobile application (the “App”), our website www.goodmannersfreight.com, or any other website, application, feature, widget, or other online service that is owned or controlled by Good Manners Freight and contains a link to this Policy (the “Site”), including through forms or applications available on the Site. “Personal Information” means any information or set of information, whether alone or in combination with other Personal Information, processed by Good Manners Freight, which is sufficient to identify an individual. Personal Information does not include information that is anonymous or de-identified, nor does it include publicly available information that has not been combined with non-public Personal Information.

What processing activities are covered by this Policy? This Policy applies to the processing of Personal Information when you use or visit the App or the Site and any features, subdomains, content, functionality, services, media, forms, applications, or solutions offered on or through the App or the Site. By accessing and using the App or the Site, or by otherwise signaling your agreement when the option is presented to you, you consent to the collection, use, and disclosure of information as described in this Policy. This Policy only governs the App and the Site, and it does not govern off-line data collection or any other website or service operated by third parties, including any third-party sites to which we may link, that do not specifically refer to this Policy. Information related to processing activities for job applicants and employees is governed by the Employment Information section of this Policy, as well as applicable third-party privacy policies available on third-party websites or applications.

HOW DO WE COLLECT AND PROCESS YOUR INFORMATION?

We collect and process the following Personal Information for the purposes set forth below.

Location InformationWe may determine your approximate location from your IP address when you visit our App and Site.
Mobile and Text Messaging InformationIf you provide your mobile phone number and opt in to receive text messages, we collect your mobile phone number and your messaging consent and preferences, as described in the SMS / Text Messaging Program section below.
Feedback, Support, and Communications PreferencesIf you provide feedback or respond to surveys, we collect your name, email address, phone number, and your communications preferences.
Contact Us DataIf you contact us, we collect your email address and the content of your correspondence.

We process this information to operate the App, Site, and services; to ensure the privacy and security of our App, Site, and services; to maintain our databases and back-ups; to manage our relationships with you; to provide and improve customer service; to communicate with you; and to keep records of our communications with you. The legal basis for this processing is your consent or, where applicable, our legitimate interests in the proper administration of our App, Site, and business, the proper management of our relationships, and the performance of a contract between you and us (or taking steps, at your request, to enter into such a contract).

Is entry of personal information required? The entry of Personal Information is required to access certain portions of the App and Site. You may choose not to provide us with Personal Information and may still access certain portions of the App and Site, but you will not be able to access portions that require your Personal Information. Where we need to process your Personal Information to comply with law, to perform a contract we have with you, or to provide services, and you fail to provide that data when requested, we may not be able to provide the services or perform the contract. We will notify you if this is the case at that time.

Aggregated Data. We also collect, use, and share “Aggregated Data,” such as statistical or demographic data, for any purpose. Aggregated Data may be derived from your Personal Information, but once in aggregated form it does not directly or indirectly reveal your identity and is not treated as Personal Information. If we combine Aggregated Data with your Personal Information so that it can identify you, we treat the combined data as Personal Information under this Policy.

Special Categories of Personal Information. Other than employment information collected in connection with your application or employment, we do not collect “Special Categories of Personal Information” or “Sensitive Personal Information” about you, including details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, or health, nor do we collect information about criminal convictions and offenses.

How do we use the information described in this Policy? To the extent permitted by applicable law, we may use the information described above in order to:

  • Operate and improve our operations, business, services, and the App and Site;
  • Provide you with services, products, content, customer service, and functionality;
  • Honor our terms of service and contracts;
  • Manage our relationship with you and your account;
  • Process and complete transactions, including payments to and from carriers, shippers, and other parties;
  • Improve our products and services and develop new products and services;
  • Maintain our databases and back-ups, including records of our communications with you;
  • Ensure the privacy and security of our App, Site, and services;
  • Detect fraud and prevent loss;
  • Support and improve the App and Site, including evaluations of functionality and features;
  • Communicate with you, including by email, telephone, SMS, or equivalent forms of electronic communication, and to respond to your feedback, requests, questions, or inquiries;
  • Market our own services and products to you (we will only send you marketing communications where permitted by law, and you may opt out at any time);
  • Assess the success of our own marketing communications;
  • Administer a contest, promotion, survey, rewards, referral, or promotional program;
  • Analyze use of the App and Site and prepare aggregate traffic information;
  • Recognize your device and remember your preferences;
  • Facilitate corporate mergers, acquisitions, reorganizations, dissolutions, or other transfers;
  • Obtain and maintain insurance coverage, manage risks, and obtain professional advice;
  • Administer your job application or employment with us;
  • Comply with federal, state, or local laws;
  • Comply with a civil, governmental, or regulatory inquiry, order, subpoena, summons, or process;
  • Cooperate with law enforcement agencies;
  • Exercise or defend legal rights or claims; and
  • Create, use, retain, or disclose de-identified or aggregated data.

If we need to use your Personal Information for an unrelated purpose, we will update this Policy and explain the legal basis that allows us to do so. We do not use Personal Information to make automated decisions that produce legal or similarly significant effects about you, and we do not engage in profiling for targeted advertising.

Marketing Communication Preferences. We may contact you with information regarding services that may be of interest to you. You can ask us to stop sending you marketing messages at any time by following the unsubscribe or update-preferences links on any marketing message, or by contacting us using the details in the Contact Us section. We may still communicate with you regarding your use of the App and Site or our services.

SMS / TEXT MESSAGING PROGRAM

Consent to receive text messages. When you provide your mobile phone number to Good Manners Freight, LLC and opt in to receive text messages — for example, through a form on our Site, a paper form, or in the course of arranging, dispatching, or servicing freight — you consent to receive SMS/text messages from us. These messages may relate to load and shipment status, dispatch and pickup/delivery coordination, check calls, billing and payment, and account or service notifications. Consent to receive text messages is not a condition of purchasing any goods or services from us.

We do not share your mobile information. Good Manners Freight, LLC does not sell, rent, or share your mobile phone number, SMS opt-in information, or text messaging consent with any third parties or affiliates for marketing or promotional purposes.

No sharing of text messaging originator opt-in data. All of the categories of information described in this Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Message frequency. Message frequency varies based on your interactions with us and the services you use.

Message and data rates. Message and data rates may apply, depending on your mobile carrier and plan.

How to opt out. You can opt out of receiving text messages at any time by replying STOP to any message you receive from us. After you reply STOP, we will send a one-time confirmation message, and you will no longer receive text messages from us unless you opt back in.

How to get help. For help, reply HELP to any message you receive from us, or contact us at 615-274-8286 or privacy@goodmannersfreight.com.

Carrier liability. Carriers are not liable for delayed or undelivered messages.

Messaging service provider. We use a third-party messaging platform solely to deliver our text messages to you. This provider processes your mobile information only to send messages on our behalf, under contract, and is prohibited from using it for any other purpose. Using a service provider to deliver our own messages to you is not sharing your opt-in data with third parties for marketing.

COOKIES AND SIMILAR TECHNOLOGIES

A “cookie” is a small file created by a web server that can be stored on your device (if you allow) for use either during a particular browsing session (a “session” cookie) or a future browsing session (a “persistent” cookie). First-party cookies are set by the website you are visiting and can only be read by that site.

We use the following categories of cookies and similar technologies on our App and Site:

Essential Cookies and Similar Technologies. These enable you to navigate the App and Site and use our services and features. Without them, the App and Site will not perform correctly, and we may not be able to provide certain services or features.

Preference Cookies and Similar Technologies. These collect information about your choices and preferences and allow us to remember language and other local settings and to customize the App and Site accordingly.

Analytics Cookies and Similar Technologies. These collect information about your use of the App and Site and enable us to improve how they work, including which pages are most frequently visited and how to debug issues. Where we use a third-party analytics provider, that provider acts as our service provider, processes the information only on our behalf, and is not permitted to use it for its own purposes or to sell or share it. We use this information to understand overall, aggregate traffic patterns, not to identify individual users for advertising.

We do not use third-party advertising or behavioral-tracking cookies, and we do not permit third parties to use cookies on our App or Site to build advertising profiles about you across other websites.

Other Similar Technologies. In addition to cookies, there are other automatic data-collection technologies, such as web beacons, pixel tags, and navigational data collection (log files, server logs), that can be used to collect data as users navigate through and interact with a website. We use these only for the essential, preference, and analytics purposes described above.

Your Choices About Cookies. You can adjust your browser settings to block or alert you about cookies, or use the cookie controls provided on our Site. For more information on blocking or filtering cookies, visit www.aboutcookies.org. To disable cookies in your browser, visit the support pages for Google Chrome, Firefox, Microsoft Edge, Safari, or iOS. These settings may affect your experience with the App and Site.

Opt-Out Preference Signals. Because we do not sell or share your Personal Information and do not use Personal Information for targeted advertising, there is no sale, share, or targeted advertising for you to opt out of through a browser-based signal such as the Global Privacy Control (GPC). To the extent applicable law requires us to honor a recognized opt-out preference signal, we will treat such a signal as a valid request consistent with that law.

Chatbot Technology. We may use chatbots to provide customer service and support. We collect the personal information you provide and store a transcript of your chat for quality control, fraud prevention, and security. While a chatbot aims to provide accurate information, it may not always be exhaustive or up to date.

Accuracy and Updating Your Personal Information. We aim to keep your personal information accurate and current. Please update your information in your account profile or contact us through the Contact Us section if it changes. We are not responsible for losses due to inaccurate or incomplete information provided by you.

HOW DO WE SHARE OR DISCLOSE YOUR PERSONAL INFORMATION?

We do not sell or rent your Personal Information, and we do not share your Personal Information with third parties or affiliates for their own marketing purposes or for targeted advertising. We share your information only in the limited contexts described below, and only where permitted by applicable law.

Professional AdvisorsWe may share your information with our and our affiliates’ insurers and professional advisors, including attorneys and accountants, that need access to provide services to us.
De-identified or Aggregated DataWe may disclose aggregated or de-identified information that does not identify any specific individual.

All of the categories above exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

HOW LONG DO WE STORE AND USE YOUR INFORMATION?

We retain and use your Personal Information for as long as is necessary to fulfill the purposes for which it was collected, to comply with our business requirements and legal obligations, to resolve disputes, to protect our assets, to provide our services, to pursue legitimate business purposes, and to enforce our agreements.

We take reasonable steps to delete the Personal Information we collect when (1) we have a legal obligation to do so, (2) we no longer have a purpose for retaining the information, or (3) you ask us to delete your Personal Information, unless doing so would violate our existing legal, regulatory, dispute-resolution, contractual, or similar obligations. When we delete data, it will be removed from our active servers and databases, but it may remain in our archives when it is not practical or possible to delete it.

To the extent permitted by law, we may retain and use anonymous, de-identified, or aggregated information for performance reporting, benchmarking, analytics, and product and service improvement.

We are required by law to maintain records of consumer requests submitted under the California Consumer Privacy Act, and how we responded, for at least twenty-four (24) months. We use this information only for recordkeeping purposes.

Right to Withdraw Consent. If you have provided consent to the collection or processing of your Personal Information, you have the right to fully or partially withdraw your consent at any time by contacting us using the details in the Contact Us section, or by following opt-out links on any marketing communications. Once we receive notice that you have withdrawn your consent, we will no longer process your information for the purpose(s) to which you originally consented, unless there are compelling legitimate grounds for further processing that override your interests, or for the establishment, exercise, or defense of legal claims. Withdrawal of consent to receive marketing communications will not affect the processing of personal information for the provision of our services.

Complaints. If you believe your rights relating to your personal information have been violated, please contact us via the Contact Us section at the end of this Policy.

DATA SECURITY

We maintain reasonable administrative, technical, and physical safeguards designed to protect the Personal Information we collect against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. No method of transmission over the Internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security. In the event of a breach of security involving your Personal Information, we will notify you and applicable authorities as required by applicable law.

EMPLOYMENT INFORMATION

If you apply for a job or become an employee, we collect personal information necessary to process your application or your employment. In this context, we collect information including, among other things, your contact information, emergency contact information, your social security number, employment history, educational history, skills and competencies, gender, ethnicity, disability status, and veteran status.

We process employment information to operate our business; to verify your eligibility and suitability for employment or other relationships with us; and to comply with your instructions or requests. The legal basis for this processing is our legitimate interests in the proper administration of our App, Site, and business and, where applicable, taking steps at your request to enter into a contract.

CALIFORNIA RESIDENTS

CCPA/CPRA Notice at Collection. For purposes of the California Consumer Privacy Act (“CCPA”) and California Privacy Rights Act (“CPRA”), in collecting the information described above, we collect the categories of Personal Information listed below from natural persons residing in California (“consumers”).

Data Practices During the Last 12 Months.

Personal Information Collected. In the preceding 12 months, we have collected the categories of Personal Information listed above (Identifiers; categories described in the California Customer Records statute; Internet or other electronic network activity information; Geolocation data; Commercial Information; and Professional or employment-related information).

Categories of Sources. We collect Personal Information directly from you when you provide it; automatically as you navigate the App and Site (including usage details, IP addresses, and information collected through cookies); and, where applicable, from our service providers.

Business and Commercial Purposes for Collecting. As identified in the “How Do We Collect and Process Your Information” section.

Personal Information Sold or Shared. We have not sold or shared personal information with third parties for their own marketing purposes or for targeted advertising in the preceding 12 months.

Sensitive Personal Information. We do not collect Sensitive Personal Information for the purpose of inferring characteristics, and we have not sold or shared Sensitive Personal Information in the preceding 12 months.

Personal Information Disclosed for a Business Purpose. We have disclosed Identifiers; categories described in the California Customer Records statute; Internet or other electronic network activity information; Commercial Information; and Geolocation data to the following categories of recipients for a business purpose: (1) corporate parents, subsidiaries, and affiliates; (2) professional advisors (accountants, attorneys); and (3) service providers and contractors (data storage, payment processing, messaging delivery, technical support, and website administration).

Your California Rights. Subject to certain exceptions, California consumers have the right to:

  • Request to Know the specific pieces and categories of Personal Information we have collected, the sources, the business or commercial purposes, and the categories of third parties to whom we disclose it;
  • Request to Delete Personal Information we have collected, subject to legal exceptions;
  • Request to Correct inaccurate Personal Information;
  • Opt Out of the Sale or Sharing of Personal Information — note that we do not sell or share Personal Information, so there is nothing to opt out of, but we honor this right if our practices change;
  • Limit the Use and Disclosure of Sensitive Personal Information; and
  • Non-Discrimination for exercising your rights. We do not offer financial incentives or price or service differences in exchange for the retention or sale of your Personal Information.

Submitting a Request. You may submit a Request to Know, Delete, or Correct via (1) your account page, or (2) email at privacy@goodmannersfreight.com, or (3) by calling 615-274-8286.

Verification Process. We are required by law to verify the identity of those who submit requests to know or to delete. We will verify your identity by matching the identifying information you provide (such as your name, email address, address, and telephone number) to the personal information we already maintain about you. We will inform you if we cannot verify your identity. If we cannot verify the identity of a person making a request for specific pieces of Personal Information, we are prohibited from disclosing those specific pieces.

Authorized Agents. Authorized agents may submit requests using the methods above. We may require you to (1) provide the authorized agent with signed permission, (2) verify your identity directly with us, and (3) directly confirm that you provided the agent permission, unless you have provided the agent with power of attorney under the California Probate Code.

Time Period to Comply. We will confirm receipt of your request within 10 business days and will respond within 45 days of receiving a verifiable request. We may extend this period once by an additional 45 days when reasonably necessary, in which case we will notify you within the first 45-day period.

California Shine the Light. Under California Civil Code Section 1798.83, California residents may request, once per calendar year, information about the personal information we shared, if any, with third parties for those third parties’ own direct marketing purposes. We do not share your personal information with non-affiliated third parties for those third parties’ direct marketing purposes.

RESIDENTS OF OTHER U.S. STATES WITH COMPREHENSIVE PRIVACY LAWS

To the extent you are a resident of a U.S. state with a comprehensive privacy law — such as Colorado, Connecticut, Montana, Oregon, Texas, Utah, or Virginia — you may have certain rights under your state’s law, subject to its conditions. These may include:

  • Right to Access the Personal Information we have collected and to receive a copy in a portable format;
  • Right to Correct inaccurate Personal Information;
  • Right to Delete Personal Information, subject to legal exceptions;
  • Right to Opt Out of the sale of personal information, targeted advertising, and certain profiling — note that we do not sell personal information, engage in targeted advertising, or conduct such profiling, so there is nothing to opt out of, but we honor this right if our practices change;
  • Right to Non-Discrimination for exercising your rights; and
  • Right to Appeal a denial of a privacy request within a reasonable time. We will respond to an appeal within the period required by applicable law.

NEVADA RESIDENTS

You may submit a verified request to privacy@goodmannersfreight.com to direct us not to make any sale (as defined under Nevada law) of any covered information (as defined under Nevada law) we have collected or will collect about you. Please provide your name and contact information, and we will respond in accordance with Nevada law. We do not sell covered information as defined under Nevada law.

MEXICO PRIVACY RIGHTS

If you are located in Mexico, you have the following rights under the Federal Law on the Protection of Personal Data Held by Private Parties (“LFPDP”). All requests should be sent to the address in the Contact Us section, and we will fulfill them to the extent required by applicable law. We store your Personal Information in the United States, where it may be subject to United States laws and to disclosure to governments, courts, or law enforcement or regulatory agencies pursuant to applicable law. By using our App and Site, you consent to the collection, storage, and processing of your information in the United States. Our service providers are required to maintain the confidentiality and security of your personal information and to use it only to provide services on our behalf or as required by applicable law.

  • Right of Access — to confirmation of whether your personal data are being processed and access to that data and related information.
  • Right of Rectification — to correct inaccurate or incomplete information.
  • Right to Cancellation — to request deletion of your personal information in certain circumstances; this right is not absolute.
  • Right to Object — to object to processing in certain circumstances.
  • Right to Withdraw Consent — to withdraw consent fully or partially.

Process. You or your representative may establish your right to exercise these rights by matching the identifying information you provide (name, email address, address, and telephone number) to the information we maintain. Within 20 days of your request, we will notify you of our determination, and we will then act within the time frame required by law.

CANADA PRIVACY RIGHTS

If you are located in Canada, you have the following rights under the Personal Information Protection and Electronic Documents Act (“PIPEDA”). All requests should be sent to the address in the Contact Us section, and we will fulfill them to the extent required by applicable law. We store your personal information in the United States, where it may be subject to United States laws and to disclosure to governments, courts, or law enforcement or regulatory agencies pursuant to applicable law. By using our App and Site, you consent to the collection, storage, and processing of your information in the United States.

  • Consent — We obtain your consent prior to collecting, using, or disclosing your personal information for any purpose. The form of consent (express or implied) depends on the sensitivity of the information and your reasonable expectations. We will not disclose, rent, sell, or otherwise transfer your personal information without your consent, except as set out in this Policy.
  • Right of Access — We will make available the specific personal information we have collected, used, or disclosed, upon request, in a form that is generally understandable.
